Terms of Service

Note: This document is a translation of the original Japanese version. In case of any discrepancy between the Japanese version and this translation, the Japanese version shall prevail.
These Terms of Service (the "Terms") set forth the terms and conditions for the use of Bingify (the "Service"). By using the Service, you agree to be bound by these Terms.
1. Definitions
In these Terms, the following terms shall have the following meanings:
- "Service": The real-time bingo application and related services provided by Bingify
- "Operator": The individual or entity operating the Service
- "User": Any person who uses the Service
- "Content": All information (including text, images, configuration data, etc.) created, posted, or shared by Users on the Service
- "Intellectual Property Rights": All rights relating to intellectual property, including copyrights, trademark rights, patent rights, and other rights
2. Acceptance of Terms
By accessing or using the Service, Users are deemed to have agreed to all the provisions of these Terms. If you do not agree to these Terms, you may not use the Service.
3. Provision of Service
- The Service provides Users with functions to create, manage, and participate in real-time bingo games.
- The Operator may change, add, or delete the content of the Service without prior notice.
- The Service is provided "AS IS." The Operator makes no warranties regarding the completeness, accuracy, usefulness, safety, or legality of the Service.
4. User Responsibility
Users shall use the Service at their own risk and bear all responsibility for their use of the Service.
5. Prohibited Conduct
Users shall not engage in any of the following acts when using the Service:
- Acts that violate laws, regulations, or public order and morals
- Acts related to criminal activity
- Acts that infringe upon the intellectual property rights, privacy rights, honor, or other rights or interests of the Operator, other Users, or third parties
- Acts that place excessive load on the Service's network or systems
- Acts that may interfere with the operation of the Service
- Unauthorized access to the Service's network or systems
- Reverse engineering, decompiling, disassembling, or otherwise analyzing the Service or software included in the Service
- Impersonating third parties
- Using other Users' IDs or passwords
- Collecting information about other Users
- Sending spam, chain letters, or similar messages through the Service
- Transmitting or providing harmful computer programs
- Religious activities or solicitation to religious organizations
- Any other acts deemed inappropriate by the Operator
6. Intellectual Property Rights
- Intellectual property rights relating to the Service belong to the Operator or third parties with legitimate rights.
- Intellectual property rights in Content created by Users on the Service belong to those Users. However, Users grant the Operator a non-exclusive, royalty-free license to use such Content (including reproduction, adaptation, and public transmission) to the extent necessary for the operation, maintenance, improvement, and promotion of the Service.
7. Disclaimer
- The Operator does not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.
- The Operator shall not be liable for any damages incurred by Users through the use of the Service, except as otherwise provided by mandatory provisions of Japanese law, such as the Consumer Contract Act.
- The Operator makes no warranties regarding the accuracy, completeness, or usefulness of information provided through the Service.
- The Operator shall not be liable for the loss, damage, or other harm to User Content, except in cases of willful misconduct or gross negligence by the Operator.
- The Service is developed and operated as open-source software, and the Operator provides the Service free of charge. The Operator shall not be liable for any data loss, service interruptions, or other damages related to the Service.
8. Service Suspension and Interruption
- The Operator may suspend or interrupt the provision of all or part of the Service without prior notice to Users in any of the following cases:
- When performing maintenance, inspection, or updates to the Service's systems
- When provision of the Service becomes difficult due to force majeure events such as earthquakes, lightning, fire, power outages, natural disasters, or other circumstances beyond the Operator's control
- When the Operator determines that provision of the Service is difficult for any other reason
- The Operator shall not be liable for any damages incurred by Users or third parties due to suspension or interruption of the Service under this provision.
9. Termination of Service
The Operator may terminate provision of the Service at its discretion with prior notice to Users.
10. Changes to Terms
- The Operator may change these Terms as necessary.
- When these Terms are changed, the Operator will post the revised Terms on the Service.
- The revised Terms shall become effective from the time they are posted on the Service.
- If Users continue to use the Service after these Terms have been changed, they shall be deemed to have agreed to the revised Terms.
11. Governing Law and Jurisdiction
- These Terms shall be governed by and construed in accordance with Japanese law.
- The Tokyo District Court shall have exclusive jurisdiction in the first instance over any disputes arising between the Operator and Users in connection with the Service or these Terms.
